Does city inspector violate any of my rights upon inspecting my house?
I just recently bought a fixer has outstanding code issues which were mitigated before my ownership. I applied for permit to replace the foundation. The code compliance inspector came and stared to dig out more problems outside and inside of the house, threaten me to let him go inside the house, he said “let me in or I will come back with a warrant” and he started shooting lots of photos and also said “if you touch anything I will fine you”. He said I might have to open existing ceiling skylight to see the framing, pointed out the plumbing, electrical outlets, etc…
I never touched anything since bought as is and the house is about 70 years old.
When fixing up a place the city inspector has the complete right to come and inspect the house. Its the reason for the permit – when you bought it there was a clause in it that said you agree to comply with all inspections. I can tell you if you really do not kiss their behinds with this, they can shut you down indefinitely and can stop any future sale of the house. Plus they can order all sorts of crazy inspections just to mess with you – like opening up a skylight to inspect framing.
